Terms Of Use

  • This website www.ocacademy.in is a cloud-based platform ("Platform"), owned and operated by OMNICURIS ACADEMY PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, having its registered office at 4th Floor, Saroj Bank Square, No 228/114/4 Boganahalli, Bengaluru - 560103 ("OC Academy").
  • By accessing or using the Platform, you signify that you have read, understood and agree to be bound by these terms of use ("Terms of Use"). These Terms of Use apply to Users of the Platform to whom OC Academy intends to impart the services which are made available through the Platform ("Services"). Depending on the nature of the Services, the same can be paid or free, which is subject to OC Academy's discretion from time to time.
  • The Services on the Platform are offered to you conditioned on your acceptance without modification of the terms, conditions and notices contained in these Terms of Use. Your access to the Platform and/or use of the Services on the Platform constitute your agreement to all such terms, conditions and notices without limitation or qualification and to be bound by these Terms of Use. If you do not agree with these Terms of Use, please do not access and/or use the Platform or avail of the Services.
  • We reserve the right to update or modify these Terms of Use at any time without prior notice. Your access and use of this Platform following any such change constitutes your acceptance to be bound by these Terms of Use, as updated or modified from time to time. For this reason, we request you to review these Terms of Use each time you access and use this Platform.
  • For the purposes of these Terms of Use, "we", "our" and "us" shall mean OC Academy and "you" and "your", shall mean a user of the Platform, whether registered or not ("User").

  • To engage in most activities on the Platform and apply for a Program, you are required to create an account ("User Account"). The registration process involves undergoing necessary verification procedures to confirm your login credentials, such as your phone number. This verification is done through a one-time password sent to your registered phone number.
  • Upon payment of the Program fees, either partially or in full, as determined by the specific Program, OC Academy will provide you with the terms of use for the Program and grant you access to it. An invoice will be included in the email confirmation or provided within two (2) months thereafter, serving as proof of delivery upon successful payment.
  • In exceptional circumstances, if OC Academy has granted you access to a Program before receiving the payment and the payment is not received within the specified timeframes, OC Academy reserves the right to withdraw your access to the Program without prior notice, at its discretion.
  • We reserve the right to update or modify these Terms of Use at any time without prior notice. Your access and use of this Platform following any such change constitutes your acceptance to be bound by these Terms of Use, as updated or modified from time to time. For this reason, we request you to review these Terms of Use each time you access and use this Platform.
  • By using the Platform, you agree not to disclose or provide access to your User Account to any third party under any circumstances. You also acknowledge and agree that you will create, use and access only one User Account and you will refrain from using any User Account other than your own.
  • During the setup of your User Account, you may be asked or required to provide additional information, including but not limited to your name and email address. Some data may be necessary to verify your identity. It is important to understand and agree that all the information you provide must be accurate, up-to-date and complete. You are responsible for maintaining and updating your information to ensure its accuracy, currency and completeness.
  • Please note that if any of the information provided by you is found to be false, inaccurate, outdated, or incomplete, OC Academy reserves the right to terminate your use of the Platform and your enrollment in a Program, to the extent applicable. In such cases, if any legal actions arise from OC Academy or any third party, you will be solely responsible for any consequences or liabilities that may arise.
  • As part of your engagement with the Platform and participation in the Programs, we may collect certain information about you, including Personally Identifiable Information. This information is obtained to facilitate the provision of services to you both presently and in the future. Additionally, we may use this information for marketing purposes.
  • Please note that even if you have registered under the Do Not Disturb (DND), Do Not Call (DNC), or National Customer Preference Register (NCPR) service, you authorize us to contact you or allow third parties to contact you, for the aforementioned purposes for 365 days from the date of your registration with us.
  • Please note that if any of the information provided by you is found to be false, inaccurate, outdated, or incomplete, OC Academy reserves the right to terminate your use of the Platform and your enrollment in a Program, to the extent applicable. In such cases, if any legal actions arise from OC Academy or any third party, you will be solely responsible for any consequences or liabilities that may arise.
  • Access to the Programs is limited to individuals who have been granted explicit access by OC Academy. By creating your User Account, you affirm the following:
    • You have registered for the Program only once and will not create multiple User Accounts.
    • You will comply with these Terms of Use as well as any additional terms and conditions specific to the Program.
  • By agreeing to these terms, you acknowledge your commitment to follow the guidelines and requirements outlined in these Terms and any Program-specific terms.
  • In certain situations, if OC Academy has provided you with access to a Program and we do not receive the agreed-upon payments within the specified period, we reserve the right to revoke your access to the Program without prior notice.
  • Once you have successfully enrolled and made the payment, you will receive access to the online course materials for the duration of the course, starting from the enrollment date or commencement date as may be applicable. Please be aware that access to the course may be subject to restrictions or termination in the event of a code of conduct violation or if the course provider chooses to modify or discontinue the course. It is your responsibility to ensure that you complete the course within the specified timeframe.
  • OC Academy reserves the right to cancel, reschedule, or modify any Program or live classes, including the schedule of topics and the assessment methods such as self-assessment tests, quizzes, exams (VIVA) and other evaluations. We strive to provide high-quality online study materials, which may result in changes or revisions to the content, curriculum and course without prior notice.
  • Furthermore, OC Academy, at its sole discretion, may limit, suspend, or terminate your use of the Platform, Programs and related services, including access to faculty, support services, evaluations and certifications. OC Academy and its partner institutions also have the right to modify any services associated with the Programs at their discretion. You acknowledge and agree that OC Academy shall not be held liable to you or any third party for any such modifications, suspensions, or discontinuations. These Terms do not obligate OC Academy to maintain or support the Platform, Programs, or associated services.
  • You also acknowledge that OC Academy shall not be held responsible for any non-availability of the Platform or any portion thereof caused by circumstances beyond its control, such as Acts of God, war, disease, revolution, epidemic, riot, civil commotion, strike, lockout, flood, fire, satellite failure, public utility failure, or any other unforeseen cause. Subject to the applicable refund policy, if you wish to discontinue your participation in any program, you must provide prior notice to OC Academy.
  • Participants of OC Academy's online live lectures and webinars will be granted access to such classes through email, SMS, or other designated communication channels. You agree not to share this access with any third party. If you are unable to attend an online live lecture or webinar, it is your responsibility to inform OC Academy in advance.
  • You are solely responsible for acquiring and maintaining any necessary equipment or additional services required to connect to, access, receive, or use the Platform. This includes hardware devices, software, internet, wireless, broadband, phone and other mobile communication device connection services. It is your responsibility to ensure that the equipment and services you use are compatible with the Platform. You are also responsible for any charges associated with using the Platform and participating in the Programs in connection with the aforementioned equipment and services.
  • Users who enroll in programs that include clinical training in partner medical institutes are required to comply with the terms mentioned above as well as the terms specified by the respective medical institutes.
  • We strive to provide uninterrupted services to our users. However, there may be instances where our systems and software programs require updates. In such cases, we will make every effort to complete the updates as quickly as possible. However, please note that there may be occasional interruptions due to factors beyond our control, such as power outages, server issues, software problems, routine maintenance, programming errors, or other unforeseen glitches. We will work diligently to minimize any disruptions caused by these factors.
